License agreement for using AtlasLinq
1. Agreement to Terms
This End User License Agreement ("EULA" or "Agreement") is a legal agreement between you ("User" or "you") and AtlasLinq ("Company," "we," "our," or "us"), governing your use of the AtlasLinq mobile application ("App") available on Google Play Store and Apple App Store.
By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by this EULA. If you do not agree to these terms, do not download, install, or use the App.
This EULA supplements our Terms of Service and Privacy Policy, which are incorporated herein by reference.
2. License Grant
2.1 Limited License
Subject to your compliance with this EULA, we grant you a limited, non-exclusive, non-transferable, revocable license to:
- Download and install the App on a mobile device that you own or control
- Use the App for your personal, non-commercial purposes
- Create and share digital business card profiles
- Access features available to your subscription tier
2.2 License Restrictions
You agree NOT to:
- Copy, modify, or distribute the App or any portion of it
- Reverse engineer, decompile, or disassemble the App
- Rent, lease, lend, sell, or sublicense the App
- Circumvent any security measures or access controls
- Use the App in violation of any applicable laws
- Remove or alter any proprietary notices or labels
- Use the App for any unlawful, harmful, or fraudulent purpose
- Interfere with or disrupt the App's operation or servers
3. Intellectual Property Rights
3.1 Our Ownership
The App, including all content, features, and functionality (including but not limited to software, text, graphics, logos, images, and user interface design) is owned by AtlasLinq or its licensors and is protected by international copyright, trademark, patent, and other intellectual property laws.
3.2 Your Content
You retain ownership of the content you create and share through the App (such as your profile information, photos, and business details). By using the App, you grant us a limited license to display and share your content as necessary to provide the service.
3.3 Trademarks
"AtlasLinq," "Atlas Linq," and our logo are trademarks of AtlasLinq. You may not use our trademarks without our prior written consent.
4. User Responsibilities
4.1 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access
- Using a strong, unique password for your account
4.2 Acceptable Use
You agree to use the App only for lawful purposes and in a manner consistent with this EULA. You will not:
- Create profiles with false or misleading information
- Share content that is illegal, offensive, or infringes others' rights
- Use the App to spam, harass, or harm other users
- Attempt to gain unauthorized access to other users' accounts
- Use the App to collect personal information without consent
4.3 NFC Usage
When using NFC features, you agree to:
- Only write to NFC tags that you own or have permission to use
- Not use NFC features to distribute malware or malicious content
- Respect the privacy of recipients when sharing your profile
5. Subscriptions & Payments
5.1 Free & Paid Tiers
The App offers both free and paid subscription tiers. Some features are only available to paid subscribers. We reserve the right to change which features are available in each tier.
5.2 Billing
Paid subscriptions are billed through our website (atlaslinq.com) via our payment processors (Razorpay for India, Stripe for international). By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
5.3 Cancellation
You may cancel your subscription at any time. Upon cancellation:
- You will retain access to paid features until the end of your current billing period
- Your account will revert to the free tier after the billing period ends
- No refunds will be provided for partial billing periods
5.4 Refunds
Refund requests are handled on a case-by-case basis. Please contact support@atlaslinq.com for refund inquiries. Refunds are generally not provided for change of mind or unused subscription time.
6. Third-Party Services
The App may integrate with or link to third-party services, including:
- Firebase (Google): Authentication, database, storage, and analytics
- Apple Sign-In: Authentication service for iOS users
- Google Sign-In: Authentication service for Android users
- Google ML Kit: On-device OCR for business card scanning
Your use of third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices or content of third-party services.
7. Disclaimers
7.1 "As Is" Basis
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
7.2 No Guarantee
We do not warrant that:
- The App will be uninterrupted, secure, or error-free
- Any defects will be corrected
- The App will be compatible with all devices
- NFC features will work with all devices or tags
- Results obtained from the App will be accurate or reliable
7.3 NFC Disclaimer
NFC functionality depends on device hardware and software capabilities. Not all devices support all NFC features. iOS devices have limited NFC capabilities compared to Android. We are not responsible for NFC hardware limitations.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ATLASLINQ, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
- ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES
- ANY DAMAGES RESULTING FROM UNAUTHORIZED ACCESS TO YOUR ACCOUNT
- ANY DAMAGES ARISING FROM YOUR USE OR INABILITY TO USE THE APP
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
9. Termination
9.1 By You
You may terminate this EULA at any time by deleting the App from your device and deleting your account through the App's settings.
9.2 By Us
We may suspend or terminate your access to the App at any time, with or without cause or notice, including if we believe you have violated this EULA.
9.3 Effect of Termination
Upon termination:
- Your license to use the App immediately terminates
- You must delete all copies of the App from your devices
- Sections regarding intellectual property, disclaimers, and limitations of liability survive termination
10. Updates & Changes
10.1 App Updates
We may release updates to the App from time to time. Some updates may be required to continue using the App. By accepting this EULA, you consent to receive automatic updates.
10.2 EULA Modifications
We reserve the right to modify this EULA at any time. We will notify you of material changes by:
- Posting the updated EULA on our website
- Updating the "Last Updated" date
- Providing in-app notification for significant changes
Your continued use of the App after changes are posted constitutes your acceptance of the updated EULA.
11. Governing Law & Disputes
11.1 Governing Law
This EULA shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. For users in the European Union, nothing in this EULA affects your rights under applicable EU consumer protection laws.
11.2 Dispute Resolution
Any disputes arising from this EULA shall be resolved through:
- Informal Resolution: Contact us first at legal@atlaslinq.com to attempt to resolve the dispute informally.
- Arbitration: If informal resolution fails, disputes shall be settled by binding arbitration in Indore, Madhya Pradesh, India, in accordance with Indian arbitration laws.
12. Miscellaneous
12.1 Entire Agreement
This EULA, together with our Terms of Service and Privacy Policy, constitutes the entire agreement between you and AtlasLinq regarding the App.
12.2 Severability
If any provision of this EULA is found to be unenforceable, the remaining provisions shall remain in full force and effect.
12.3 Waiver
Our failure to enforce any right or provision of this EULA shall not be considered a waiver of those rights.
12.4 Assignment
You may not assign or transfer this EULA. We may assign our rights and obligations without restriction.
